ELITE HOCKEY CAMPS, LLC

REQUIRED LIABILITY WAIVER

 

PLEASE READ CAREFULLY BEFORE ACCEPTING

THIS IS AN ASSUMPTION OF RISK AND RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS 

In consideration of my CHILD being provided hockey training by Elite Hockey Camps, LLC, I agree to the following waiver and release: 

 

I acknowledge that off-ice training, skating, playing ice hockey, and being on or around an ice rink have inherent risks, hazards and dangers. I understand that these risks, hazards and dangers include without limitation: (1) risks arising from exposure to large and sudden changes in environmental temperatures that can lead to loss of consciousness, hypothermia, heart attacks, and other life-threatening conditions; (2) risks involved in participating in off-ice workouts and skill sessions; (3) risks arising from on ice lessons; (4) risks arising during an ice hockey camp; and (5) such other risks, hazards, and dangers inherent to the sport of playing hockey.

 

I have allowed my CHILD to participate in off-ice training, skill sessions, on-ice lessons, and hockey camps with my full knowledge of the inherent risks, hazards, and dangers involved and, on behalf of my minor CHILD, I hereby assume and accept any and all risks of injury, illness, paralysis, or death, and agree to abide by all regulations, rules and guidelines set forth by Elite Hockey Camps, LLC and/or the facilities and ice arenas where training, lessons, and camps are provided.

 

I, for myself, my CHILD, my family and relatives, my heirs, successors, executors, and subrogors, hereby knowingly and intentionally waive and release, indemnify, and hold harmless Elite Hockey Camps, LLC and/or any of their directors, officers, members, owners, partners, agents, affiliates, employees, contractors, sponsors, or volunteers, from and against any and all claims, actions, causes of action, liabilities, suits, costs, damage, expenses (including reasonable attorney’s fees) and negligence of any kind or nature, whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, illness, paralysis, or death to me or my property as a result of participation in the Membership Agreement, whether such damage, loss, injury, illness, paralysis, or death results from the negligence or other acts however caused by or contributed to by Elite Hockey Camps, LLC and/or and all related entities and persons named above, or from any other cause. I, for myself, my CHILD, my family and relatives, my heirs, my successors and assigns, executors, and subrogors, further agree not to sue Elite Hockey Camps, LLC and/or or other assisting agencies, their directors,  officers, members, partners, owners, agents, affiliates, employees, contractors, sponsors, or volunteers, as a result of any injury, illness, paralysis or death suffered in connection with my CHILD’S participation in the services provided under the Membership Agreement. I also attest that I am of the age of 18 years or older and have the legal authority to sign this document on behalf of my minor CHILD.

 

I ACKNOWLEDGE, ON BEHALF OF MYSELF AND MY MINOR CHILD, THAT WE ARE CHOOSING TO VOLUNTARILY PARTICIPATE IN ELITE’S ACTIVITIES OR SERVICES PROVIDED UNDER THE MEMBERSHIP AGREEMENT, INCLUDING BUT NOT LIMITED TO PLAYING ICE HOCKEY, AND I ACKNOWLEDGE MY CHILD’S PARTICIPATION IS NEITHER URGENT NOR NECESSARY.

 

I ACKNOWLEDGE, ON BEHALF OF MYSELF AND MY MINOR CHILD, THAT WE ARE VOLUNTARILY ENTERING THE PREMISES AND PARTICPATING IN ELITE’S ACTIVITIES OR SERVICES, INCLUDING BUT NOT LIMITED TO OFF-ICE TRAINING, OFF-ICE SKILLS, ON-ICE LESSONS, AND PLAYING ICE HOCKEY, WITH KNOWLEDGE OF THE DANGER INVOLVED AND WE HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DEATH, OR PROPERTY DAMAGE, WHETHER CAUSED BY THE NEGLIGENCE OF ELITE HOCKEY CAMPS, LLC, ITS EMPLOYEES, AGENTS, AND SERVANTS, OR OTHERWISE.

 

BY CHECKING THE BOX ON THE ELITE MEMBERSHIP SIGNUP FORM RELATED TO THIS WAIVER AND RELEASE, I AGREE AND ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT MYSELF AND MY CHILD ARE GIVING UP SUBSTANTIAL LEGAL RIGHTS ON BEHALF OF MYSELF AND MY MINOR CHILD, INCLUDING THE RIGHT TO SUE ELITE HOCKEY CAMPS, LLC, AND ITS DIRECTORS, OFFICERS, MEMBERS, PARTNERS, OWNERS, AGENTS, AFFILIATES, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, SPONSORS AND VOLUNTEERS.
